Welcome to Taber Connect, an application developed and operated by Kreative Media & IT Solutions. By accessing or using this application, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

  1. Company Identity

Kreative Media & IT Solutions operates under the name Taber Connect. For all legal, contractual, and operational purposes, Kreative Media & IT Solutions and Taber Connect are the same entity. Any references to Taber Connect in this application, agreements, or communications shall be deemed as references to Kreative Media & IT Solutions.

  1. User Agreement

By registering or accessing this application, you agree to:

  • Provide accurate and complete information when creating your account.
  • Use the platform responsibly and refrain from illegal or harmful activities.
  • Comply with all local, provincial, and federal laws while using the app.
  • Not misuse the platform for spam, fraud, or any illegal purpose.
  • Be solely responsible for your interactions and transactions with vendors or service providers.
  1. Vendor Agreement

By registering as a Vendor on Taber Connect, you agree to the following:

  • Provide accurate and up-to-date business details, including pricing, services, and availability.
  • Honor all offers, discounts, and services posted on Taber Connect.
  • Abide by all local business laws and regulations, including health and safety standards.
  • Ensure all products or services offered are legally compliant and safe for consumer use.
  • Not use the platform for any fraudulent or illegal business activities.
  • Maintain a professional conduct when interacting with users, customers, and delivery drivers.
  • Be solely responsible for the fulfillment of orders, including delivery or other services related to your offerings.
  1. Delivery Driver Agreement

By registering as a Delivery Driver on Taber Connect, you agree to:

  • Provide accurate and complete personal details, including your vehicle information and delivery availability.
  • Follow all local traffic and safety laws during deliveries.
  • Ensure the safe and timely delivery of orders to users.
  • Not engage in any conduct that may harm the reputation or safety of Taber Connect, vendors, or users.
  • Maintain the condition and safety of your delivery vehicle at all times.
  • Report any delivery-related issues or discrepancies to Taber Connect immediately.
  • Comply with all vendor instructions regarding delivery and customer service standards.
  1. Community Services and Features

Taber Connect is designed to empower the local community by:

  • Connecting residents with local businesses, services, real estate opportunities, and more.
  • Offering features like last-minute deals, donation requests, volunteer opportunities, and food delivery services.
  • Users, vendors, and delivery drivers must conduct themselves responsibly within the platform.
  1. Liability Disclaimer
  • Taber Connect provides a platform for users to connect and engage with businesses and services.
  • Kreative Media & IT Solutions (Taber Connect) does not guarantee the quality of services or products offered by vendors or the performance of delivery drivers.
  • All transactions, bookings, or services conducted through the app are the sole responsibility of the respective parties (users, vendors, or delivery drivers).
  • Kreative Media & IT Solutions is not liable for any direct, indirect, or consequential damages arising from the use of the platform.
  1. User Conduct

You agree not to:

  • Post false, misleading, or inappropriate content.
  • Misuse the platform for spam, fraud, or illegal activities.
  • Infringe upon the rights of others, including intellectual property rights.
  • Engage in any disruptive or harmful conduct towards other users, vendors, or delivery drivers.

Violation of these rules may result in account suspension or permanent termination.

  1. Privacy Policy

Your privacy is important to us. We collect and use personal data in accordance with our Privacy Policy, which outlines how information is gathered, used, and safeguarded. By using Taber Connect, you consent to the terms of the Privacy Policy.

  1. Intellectual Property

All content, logos, trademarks, and material within the app are the property of Kreative Media & IT Solutions (Taber Connect). Unauthorized use, reproduction, or distribution is strictly prohibited.

  1. Modification of Terms

Kreative Media & IT Solutions reserves the right to update or modify these Terms and Conditions at any time. Continued use of the platform after changes indicates your acceptance of the revised terms.

  1. Termination

We reserve the right to terminate or suspend your access to the platform at our discretion, without prior notice, if you violate these terms. This applies to users, vendors, and delivery drivers.

  1. Governing Law

These Terms and Conditions are governed by the laws of the Province of Alberta, Canada. Any disputes arising out of the use of this app will be subject to the exclusive jurisdiction of the courts of Alberta.

2. Definitions

  • Vendor: Businesses or individuals offering goods or services on Taber Connect.
  • User: Individuals or businesses using the Platform to purchase goods, request services, donate, or connect with the community.
  • Delivery Driver: Independent contractors providing delivery services for Vendors.
  • Taber Connect: The mobile application and website that facilitate local services, food orders, real estate listings, deals, and other community connections.

3. Vendor Terms and Conditions

3.1 Registration and Vendor Account

  • Vendors must provide accurate, up-to-date information during registration (business name, address, contact details, etc.).
  • You agree to update your profile, product listings, and service availability regularly.
  • Vendor registration is subject to a fee. Currently, the first-year fee is $200 CAD, with discounts as applicable.

3.2 Product and Service Listings

  • Vendors are solely responsible for listing accurate descriptions, pricing, and availability.
  • Any false or misleading information may result in suspension or termination of your account.

3.3 Order Fulfillment

  • Vendors must ensure timely preparation and fulfillment of orders.
  • Vendors agree to communicate any delays or unavailable products promptly to Users.

3.4 Quality and Compliance

  • Vendors must comply with all local laws and regulations regarding product safety, food hygiene, or service delivery.
  • Vendors are responsible for ensuring perishable items listed under “Last Minute Deals” are safe for consumption and meet quality standards.

3.5 Payments and Fees

  • Vendors will receive payments directly through the Platform’s secure payment gateway.
  • Taber Connect will charge a small commission for each transaction (specific commission rates will be outlined during vendor onboarding).
  • Failure to pay registration or service fees may result in account suspension.

3.6 Promotions and Broadcast Messages

  • Registered Vendors are entitled to free broadcast messages as part of their registration package. Additional broadcasts will incur separate fees.

3.7 Dispute Resolution

  • Vendors agree to handle disputes with Users professionally.
  • Taber Connect reserves the right to mediate disputes and make decisions that are binding on both parties.

4. User Terms and Conditions

4.1 User Account and Responsibilities

  • Users must register an account to access all Platform features.
  • Users agree to provide accurate contact and payment details.
  • Sharing false information or misuse of the platform will result in account suspension.

4.2 Food Orders and Services

  • Users are responsible for reviewing vendor profiles, products, and services before placing an order.
  • Any complaints regarding product quality or services must be reported to the Vendor first, with Taber Connect assisting in dispute resolution where necessary.

4.3 Donations and Volunteer Services

  • Users may use the “Donation” and “Volunteer” features to create or contribute to community initiatives.
  • All donation requests must be genuine and clearly state the purpose of funds.

4.4 Last-Minute Deals

  • Users purchasing perishable goods in the “Last-Minute Deals” section acknowledge that items may be nearing expiration but are safe for consumption as per Vendor listings.

4.5 Payments

  • All payments must be made through the Platform’s secure payment gateway.
  • Users agree not to bypass the Platform for transactions initiated on Taber Connect.

4.6 User Conduct

  • Users must treat Vendors, Delivery Drivers, and fellow Users with respect.
  • Abusive behavior, fraudulent transactions, or platform misuse will result in account termination.

5. Delivery Driver Terms and Conditions

5.1 Independent Contractor Status

  • Delivery Drivers are independent contractors, not employees of Taber Connect.
  • Drivers are responsible for their own taxes, insurance, and other legal obligations.

5.2 Driver Registration

  • Drivers must provide valid identification, vehicle registration, insurance, and other necessary documents.
  • Taber Connect reserves the right to verify documents and approve/reject applicants.

5.3 Delivery Obligations

  • Drivers agree to deliver orders promptly and safely to Users.
  • Any delays, incorrect deliveries, or damage during transit must be reported immediately.

5.4 Payments

  • Delivery fees are paid directly to Drivers through the Platform.
  • Drivers agree to any commissions or platform fees deducted from their earnings, as outlined during onboarding.

5.5 Professional Conduct

  • Drivers must conduct themselves professionally with Vendors and Users.
  • Misconduct, repeated delivery complaints, or platform misuse will result in removal from the Platform.

6. General Terms Applicable to All Users

6.1 Platform Availability

  • Taber Connect strives for uninterrupted service, but we do not guarantee continuous availability. Technical issues, maintenance, or unforeseen circumstances may affect Platform access.

6.2 Privacy and Data Use

  • Taber Connect collects and processes data in accordance with our Privacy Policy.
  • By using the Platform, you consent to the collection and use of your information for service delivery and improvement.

6.3 Intellectual Property

  • All content, trademarks, and features on the Platform are the property of Taber Connect. You agree not to reproduce, distribute, or misuse any proprietary materials.

6.4 Prohibited Activities

Users, Vendors, and Drivers agree not to:

  • Misrepresent themselves or engage in fraudulent activities.
  • Upload illegal, offensive, or harmful content.
  • Bypass or misuse payment systems.
  • Use the Platform to conduct unlawful activities.

6.5 Limitation of Liability

  • Taber Connect is not liable for product quality, services, delivery issues, or damages caused by Vendors or Drivers.
  • We act as an intermediary to connect Users, Vendors, and Drivers.

6.6 Termination

  • Taber Connect reserves the right to suspend or terminate any account for violations of these Terms.

6.7 Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada.
